In Rare Move, Department of Justice Pushes Back on National Association Realtor’s Lawsuits

The Department of Justice (DOJ), in a seldom taken action, took issue with the National Association of Realtors (NAR) “action to dismiss” a number of anti-trust suits facing the industry. The suits accuse the NAR and a number of large brokerages of colluding to inflate commissions by requiring sellers to pay fees for both listing and buyer agents. 

 Rob Hahn, a partner at the real estate consultancy 7DS, said it was “extremely rare” for the DOJ to comment on civil suits, and thus practically eliminates the chances that the suits will be dismissed.
